By inviting Ivar to your Discord server and using its features, you agree to be bound by these Terms of Service ("Terms", "Agreement"). These Terms govern your access to and use of Ivar's services, including all features, functionalities, and content provided through the Ivar Discord bot application ("Service").

Please read this Agreement carefully before accessing or using our Service. If you do not agree to all the terms of this Agreement, then you may not access or use the Service.

Acceptance of Terms

By accessing or using our Service in any way, including by inviting the Ivar Discord bot to your server, executing Ivar commands, or interacting with Ivar's messages and interfaces, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. In that case, "you" and "your" will refer to that organization.

Description of Service

Ivar is a Discord bot application that provides various features and tools for enhancing and managing adult-oriented Discord communities, with a focus on BDSM and kink-related roleplay and interaction. The Service includes, but is not limited to: dynamic ownership and submission mechanics, punishment and restriction systems, safeword monitoring, user profile customization, engagement metrics and leaderboards, chat moderation tools, and anonymized content sharing.

Age Restrictions

The Service is intended ONLY for users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old. If you are under the age of 18, you may not use the Service under any circumstances. If we learn that an underage user is using the Service, we will take immediate action to remove that user and all associated data from our systems.

User Conduct and Content

You are solely responsible for your conduct and any data, text, information, usernames, images, graphics, photos, profiles, audio and video clips, links, and other content or materials that you submit, post, or display on or via the Service.

By using the Service, you agree NOT to:

• Violate any applicable laws, regulations, or Discord's Terms of Service and Community Guidelines

• Use the Service for any illegal, unauthorized, or otherwise improper purposes

• Impersonate any person or entity, or falsely claim an affiliation with any person or entity

• Post or transmit any content that is hateful, threatening, abusive, harassing, defamatory, obscene, indecent, or otherwise objectionable

• Bypass or circumvent any Service security features or access restrictions

• Use the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service

• Attempt to indicate any sponsorship, approval, or endorsement by Ivar or its creators without express written consent

Ivar reserves the right, but has no obligation, to monitor, refuse, or remove any content or accounts that, in our sole discretion, violates these Terms or may harm the Service or our users.

Relationship to Discord

Ivar operates as a third-party application on the Discord platform. Your use of Discord is governed by Discord's Terms of Service, and Ivar has no control over Discord's operations or policies. Ivar is not affiliated with, sponsored by, or endorsed by Discord Inc.

While we strive to adhere to Discord's rules and guidelines in the operation of our Service, we are not responsible for any actions taken by Discord, including the suspension or termination of your Discord account. Any disputes with Discord must be resolved directly with them according to their terms.

Disclaimer of Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. IVAR AND ITS CREATORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED IN THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, IVAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IVAR DOES NOT WARRANT THAT THE SERVICE, INFORMATION, CONTENT, OR MATERIALS INCLUDED IN THE SERVICE ARE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

Limitation of Liability

YOU AGREE THAT IVAR, ITS CREATORS, AFFILIATES, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH CONTENT OR THE SERVICE. THE CREATORS OF THE SERVICE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless Ivar, its creators, affiliates, employees, agents, partners, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Service.

Modifications to the Service

Ivar reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) at any time, with or without notice. You agree that Ivar, its creators, affiliates, employees, agents, partners, or licensors shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes to the Terms

Ivar reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
